Twenty Five State Attorneys General and the Humane Society File Brief with the US Supreme Court to Reinstate Federal Animal Cruelty Law!

June 16th, 2009

Led by Florida Attorney General Bill McCollum, twenty five state Attorneys General, along with the Humane Society of the United States, filed amicus briefs with the United States Supreme Court to reinstate a federal animal cruelty law that was previously struck down by the Third Circuit Court of Appeals last year.  The 1999 federal Depiction of Animal Cruelty Act prohibited the sale or distribution of material portraying illegal and extreme acts of animal cruelty, including animal “crush” videos.  Such videos often depict women in high-heeled shoes impaling kittens and puppies to death but also include depictions of brutal animal fighting.  The law was previously struck down on the grounds that the “crush” videos and other material constituted “protected speech”; moreover, the Court of Appeals ruled that the prevention of animal cruelty was not the kind of “compelling” state interest to justify limitations on such speech. State Senate Passes Pet Responsibility Act

June 3rd, 2009

Let me start by saying that it’s about time that we get this legislation fixed. Hopefully in the very near future ALL of California’s pet owners are going to have to spay or neuter their dogs and cats or face the consequences. The bill, introduced by Senate Majority Leader Dean Florez passed the State Senate this week by a vote of 21-16 and now moves to the Assembly.

“I think we can all agree that the quarter of a billion dollars we spend to house and kill unwanted pets could be much better spent protecting health care for the elderly and education for our children,” Florez said.

California taxpayers spend more than $250 million every year to kill half a million unwanted pets and house twice as many homeless pets.

Will it work? Well, when a similar ordinance was adopted in Santa Cruz, euthanasia there dropped by 60 percent so I’d say that we’re headed in the right direction.

Senate Bill 250 now heads to the California State Assembly for consideration. Let’s all keep our fingers crossed.
